Taylor will discuss the various merits and pitfalls of forensic vs. proactive approaches to the collection of electronically stored information (ESI) for eDiscovery and Freedom of Information Act requests. The session will highlight the role of archiving and backup in creating a more proactive and defensible pool of data to drive efficiency in IT and legal teams resulting in reduced costs and risks. Specific examples will be used to highlight and contrast the different approaches IT departments currently use to handle legal requests to find data both from online and offline storage environments and how multiple instances of litigation or search requests compound the complexity and cost of this task.
